SALES CONTRACT
WHEN YOU PURCHASE OR PLACE A HOLDING FEE ON ANY PUPPY/DOG YOU AGREE IN FULL TO THE TERMS LISTED IN OUR PUPPY CONTRACT, REGARDLESS IF YOU HAVE SIGNED THE DOCUMENTS OR NOT.
This agreement is made and entered into this day of __________________ between (HMA) HEAVENLY MINI AUSSIES LLC (Seller/HMA), and __________________________________________________________ (Buyer), for the purpose of setting forth terms and conditions of purchase by the buyer of a purebred Miniature/Toy Australian Shepherd from the litter whelped on (D.O,B,)___________________ PUPPY_____________________________________
out of SIRE ________________________& DAM___________________________
Said puppy is being sold to the buyer without breeding rights. Should buyer chose to break any of the portions of this agreement, the remainder of the agreement will be considered null and void, and seller will have the right to repossess the puppy/dog without refund. Buyer and seller agree that this Contract will be governed by the laws of the State of South Carolina and may not be altered, modified, or rescinded unless agreed in writing by both the buyer and the seller.
PURCHASE AGREEMENT
1. For the sum of $_________________, the seller agrees to sell, and the buyer agrees to purchase a female / male puppy from the litter described above. When A reservation is placed for a puppy, A $300 HOLDING FEE is required. The HOLDING FEE goes towards the total purchase price of the puppy and is NON REFUNDABLE. BALANCE IS DUE BEFORE THE PUPPY IS 8 WEEKS OF AGE.
2. The seller is NOT allowing breeding rights to the said buyer. Seller warrants that the above described puppy is a purebred Miniature/Toy Australian Shepherd and is able to be registered with ASDR and that the registration paperwork has been provided to the buyer as of the date of the completed purchase. IF said puppy was spay/neutered by Seller beforehand. Otherwise Said puppy is to be spay/neutered before the puppy is SIX MONTHS of age by Buyer at Buyers expense. Registration will be released after Seller receives letter of proof of spay/neuter by A licensed small animal veterinarian from Buyer by the puppy's age of 6 months. Failure to adhere to this agreement will result in breach of contract and said puppy and its buyer will be subject to full legal consequences according to the litigation laws of the State Of South Carolina. Failure to comply will also relinquish your rights as owner of said puppy and puppy will be returned immediately to the Seller at Buyer’s expense. By signing this agreement this buyer is bound by this agreement to NOT breed any dog sold without breeding rights. Seller requires that all puppies registered by the buyer will have their registered name with any/all registries start with HMA (example: HMA Whispering Willow)
3. Seller guarantee’s puppy to be sound and free of diseases at time of transfer of said puppy to buyer. UNDER NO CIRCUMSTANCES (HMA) HEAVENLY MINI AUSSIES LLC PAY ANY VETERINARY EXPENSES INCURRED BY THE BUYER. All puppies are sold in good health, with up-to-date age appropriate vaccinations. Puppies are wormed at 2,4,6,8 weeks. As well as given Interceptor Plus for worm/heartworm prevention at age 6-8 weeks of age depending on weight of pups. Even after receiving first vaccinations by the breeder, It is recommended that you do not take your puppy anywhere until one week following the final vaccine completing the puppy series of vaccines. Seller is not responsible for stress related outbreaks caused by the transfer of said puppy to a new environment, changes, travel, etc. This guarantee excludes transmitted diseases such as distemper, parvo, bordatella, giardia, coccidia, or any other transmitted diseases caused by parasites, bacteria, virus, single celled organisms or one-celled parasitic species. Seller will make themselves available to buyer for questions, concerns, and to assist with advice on any level to maintain a smooth and stress-free transition as possible. Buyer will contact the seller immediately upon seeing signs of stress, weakness, or illness during the adjustment transition period. Buyer is required to take said puppy to a qualified veterinarian immediately upon seeing any signs of distress. Buyer is required to follow all instructions provided by veterinarian to assure a full recovery.
4. Buyer agrees to have said puppy examined by a licensed small animal veterinarian within 72 hours of receipt of said puppy. By signing this contract, buyer waves the health guarantee if not examined during the 72 hour trial period. If said puppy is to be found in poor genetic health during this time period, as evidenced by a signed written report by a licensed small animal veterinarian must be received by seller, the buyer will have the option to return the puppy at buyer’s expense for A replacement puppy as soon as comparable (of equal value) becomes available or keep said puppy and assume all care/expenses. Seller has the right to request a second opinion from a non-associated veterinarian within a reasonable distance from the buyer’s home. Or Buyer may choose To keep/treat said puppy. If the buyer decides to keep said puppy, they will assume all expenses involved with said puppy in regard to expense of care with no refunds.
5. Seller warrants that said puppy is the progeny of breeding dogs that are full Breed Panel Genetically Tested themselves for Genetic Defects known to the breed or by Parentage. Majority of our breeding dogs are Full Panel clear with the exception of a couple of our breeding females being Single Copy PRA (this is a recessive gene and they and their puppies will be non affected). For safe Breeding.
Additional debilitating conditions due to genetic health problems that we may not have tools to test for must be discovered 12 months from birth of said puppy. Buyer must notify Seller within 24 hours of 1st diagnosis with a written statement from first licensed veterinarian. Failure to send a written report from licensed small animal veterinarian to seller within 24 hours of exam voids this guarantee. They must be submitted by two different veterinarians at two different clinics certifying that said puppy is suffering from A genetic defect.
At this time buyer can either keep said puppy & assume all medical expenses or return said puppy at buyer’s expense either decision HMA will give a replacement puppy of equal value.
6. Buyer certifies, by signing this agreement, that said puppy will live with the buyer, that said puppy will have adequate exercise, love and attention, proper housing and shelter, nutritious food, fresh water, and all necessary health care from a licensed veterinarian. Said puppy will at all times be apart of the family. Said puppy will be given all necessary vaccinations and deworming necessary to keep said puppy healthy and safe from disease. Buyer agrees that he/she is not acting as an agent in this purchase and that he/she will not sell said puppy to a pet store, guard dog business, or research facility.
7. Seller shall not be held responsible for the development of disqualifying faults, diseases, disorders, or temperament which is due to buyer’s negligence. Seller is not responsible for acts of the puppy, which are due to the buyer’s negligence as people treat and train their puppies/dogs differently. Should said puppy exhibit aggressive behavior which buyer deems intolerable and irreversible with (1) one year of its birth, buyer will provide seller with proof of obedience classes or other structured training methods that have been attempted with no results. IF AT ANY TIME IN THE LIFE OF SAID PUPPY/DOG, the need arises for buyer to relinquish ownership of said puppy/dog, seller has the FIRST right of receiving the said puppy/dog back from the buyer. At no time will said puppy/dog, be sold or given away to any person, shelter, or institution without the consent of the seller. No refund will be given under these circumstances. Seller does not guarantee the adult size, weight, and eye color of puppy for obvious reasons.
8. Buyer agrees to provide puppy with the adequate, but not excessive exercise, prior to one year of age. Appropriate exercise may constitute no more than a one-mile walk on a leash, swimming, or allowing puppy to play in a fence area. Long hikes or runs with owner, jumping off furniture, etc. is harmful to a puppy’s back and joints which are not yet fully developed. If diagnosed with hip dysplasia, it is likely caused by the lifestyle of the puppy/dog and HMA Heavenly Mini Aussies LLC will not be held liable. If you look at that list of risk factors, you will see that too many of them are the very sorts of things that are quite likely to happen in the puppy’s new home. Over- feeding, changes in diet, inappropriate exercise, stairs, all can turn a little hip laxity into a lifetime of painful dysplasia. A little too much love can go a long, long way. We still have a lot to learn about Hip Dysplasia, but we do know that there are environmental factors that affect risk. The new puppy owner takes over management at a critical time in skeletal development, and many probably don’t realize this judging by the number of YouTube videos of puppies falling downstairs. Skidding across the wood floor to slam into the living room wall. These are just a few of the non- genetic factors that can also affect whether the developing hip joint will be normal or dysplastic.
9. The buyer agrees said puppy will receive Nu Vet Plus Wafers FOR THE LIFE OF THE DOG and from date of this contract to ensure that said puppy will have optimum protection and a boosted immunity builder to whatever his environment might be during his critical growth stages. Nu Vet Plus tablets supplements are required as part of your pet’s health guarantee. SEE ATTACHED ADDENDUM. This agreement is made and signed by both parties to insure the well-being and protection of this puppy. The buyer has read and understands the forgoing agrees that ALL parts of this contract are a binding agreement with the seller. If the buyer breaches any part of this agreement, the seller is released from any obligation under this agreement. If either the buyer or the seller takes legal action regarding this contract, action will be initiated in the county of the seller’s residence. Legal fees and court courts shall be the responsibility of the party found at fault.

Dear Puppy Buyer,
PLEASE NOTE THAT NU VET PLUS IMMUNE SYSTEM BUILDER ARE REQUIRED AS PART OF YOUR PET’S HEALTH GUARANTEE!
